Lingvo API. Terms of Use

Limited Liability Company Abbyy PRO (hereinafter referred to as ABBYY) offers an Internet user (hereinafter referred to as the User) the use of Lingvo API Service on the terms and conditions set out herein (hereinafter referred to as the Terms).

1. General provisions

1.1. Terms and Definitions
Lingvo API is a programmable application interface which consists of classes, procedures, functions, structures and constants offered to the User for further integration in standalone User’s software. The Service offers online instruments for words’ translation from one language to another available in the list of the languages provided by the Service.

1.2. These Terms of Use regulate the use of the Service by the User.

1.3. By publishing the Service code on the User’s Web site or by employing any other functional possibility of the Service, the User fully accepts and undertakes to abide by these Terms. The beginning of the usage of the Service by the User shall mean a full acceptance of the Terms of Use by the User in accordance with Item 5, Article 1286 and Item 2, Article 484 of the Civil Code of the Russian Federation. The use of the Service different to the terms and conditions stated in the Terms of Use is acceptable only upon ABBYY’s prior consent by conclusion of a written contract. IN CASE THE USER DOES NOT AGREE WITH ANY OF THE TERMS OF THE CURRENT TERMS OF USE, THE USER SHALL HAVE NO RIGHT TO APPLY THE CODE OF THE SERVICE ON HIS/HER WEBSITE OR APPLY IT ANYWHERE ELSE AS WELL AS USE THE ABBYY SERVICE IN ANY OTHER WAY. IN CASE THE CODE HAS BEEN ALREADY APPLIED, THE USER SHALL REMOVE IT IMMEDIATELY.

1.4. Taking into account the location of the service in the World Wide Web, the User bears at his discretion responsibility for complying with the Law when using the Service. The User bears his sole responsibility that his individual use of the Service does not breach any Law that restrict such use of the Service.

1.5. These Terms and Conditions and relations between ABBYY and the User arising in connection with the use of the Service are governed the law of the Russian Federation.

2. Terms of Use of the Service

2.1. The User may use the data and functions received with the use of the Service exclusively on the Websites whose domains belong to the User or in the applications and services that belong to the User or managed by the User on legal conditions.

2.2. The User may apply the Service functionality as well as the data received by the Service only as the basic functionality provided by the Service for any purposes including a commercial application if the User abides to the terms of restrictions stated in the current Terms of Use.

2.3. The User may not change, decompile and/or otherwise modify the program code received via the Service, as well as save, process and modify the Data obtained by means of the Service, including temporary storage (caching) of the Service Data.
As part of these Terms of Use ABBYY grants the User a non-exclusive nontransferable license. The User has the right to use the Service strictly in accordance with the outlined by the Rights Holder (ABBYY) functional possibilities of the Service. The Service may be used entirely for demonstration and for information as part of the content displayed in the User’s application as part of the page content which is accessed via a data network.

2.4. ABBYY reserves the right to set any limits and restrictions, including but not limited to those stated below:

2.5. ABBYY may change the limits and restrictions at its discretion without any prior written notice to Users.

2.6. In case the User exceeds the limits set by ABBYY for the volume of the characters translated, ABBYY reserves the right to deny access to the Service.

2.7. When using the Service the User shall include reference to the Lingvo brand in the description of the software application, in the respective help topic, on the official website of the software application, as well as on all pages/screens where the data of the service is used, strictly over or under the results of translation, in format of the following text: «Translated by Lingvo» with the clickable hyperlink to the page https://developers.lingvolive.com. The font size of this reference shall not be less than the size of the main text font, and its color shall not differ from the color of the main text font.

2.8. ABBYY reserves the right to change, revise or update the Service at any time, without any prior notice to the User. When releasing the next major version, ABBYY will announce its release on the web pages of the Service. After release of an updated version of the Service ABBYY provides no guarantee of stability and operating capacity of the obsolete versions. If the User does not agree to use an updated version of the Service, the User may continue using the obsolete version of the Service at his own risk and peril, or may stop using the Service by deleting a corresponding code from the User’s Web site(s).

2.9. The Service shall have the right at its own discretion to terminate or suspend the User’s access to the Service without any notice or statement of reasons, specifically, if the User breaches the requirements of these Terms and Conditions.

3. Intellectual Rights

3.1. The exclusive right to the Service as well as to all programmable interface and linguistic content that is part of the Lingvo API belong to ABBYY.

3.2. When using the Service, the User may not delete, hide or modify any trade marks, logotypes, links and other references to ABBYY and Lingvo or other parties, contained in or received via the Service, as well as any other notices and/or information transmitted by the Service.

4. Disclaimer

4.1. The Service is provided by ABBYY «as is». ABBYY provides no guarantee of the consistency of the Service allowed by the applicable legislation. ABBYY shall not guarantee fulfillment of the User’s goals and expectations, uninterrupted error-free operation of the Service in its entirety or of its individual components and/or functions. ABBYY offering access to the Service shall exclude any guarantees regarding the Service. ABBYY does not guarantee that any functions or content on it will be free from errors or omissions, will work with no downtime or errors, that the errors will be eliminated immediately, that the Service or the service of the Service shall be free of viruses or malfunctions. ABBYY does not guarantee the correctness, exactness and usefulness of the code from the point of view of its application to an individual usage. All the mentioned above is applicable only they do not violate the applicable legislation.

4.2. ABBYY bears no liability and indemnifies for no damage, direct or indirect, suffered by the User of the Service or third parties as a result of the use or inability to use the Service.

4.3. The User bears at his discretion liability to third parties for his actions when using the Service, particularly, for ensuring that his actions comply with the requirements of the Law and do not breach third party rights and legitimate interests. The User undertakes to settle at his discretion and expense any and all claims and/or lawsuits of third parties relating to the User’s actions during the use of the Service as well as the consequences of such actions including damage to ABBYY and its liability to third parties. ABBYY bears no responsibility for the User abiding the applicable law when using the Service.

5. Final Provisions

5.1. All questions and complaints relating to the use of/inability to use the Service must be sent to lingvo.api@abbyy.com.

5.2. ABBYY may at any time change the text of these Terms without any notice to the User. The effective version of these Terms is published at: https://developers.lingvolive.com/en-us/about/terms. An updated version of the Terms and Conditions becomes effective from the moment it is published in the Internet at the address specified in this paragraph. Continuing to use the Service after revision of the Terms is deemed as acceptance of their revised version. The User must stop using the Service if the User does not agree with any revisions made by ABBYY in these Terms.
